Pinnacle court expunges expressions like “mysterious and frenzied rush” utilized by HC judge
The Supreme Court on Monday reserved a Delhi High Court order questioning the “frenzied rush” with which civil rights advocate Gautam Navlakha was moved out of the National Capital to Mumbai in connection with the Bhima Koregaon case.
A three-judge Bench led by Justice Arun Mishra expunged expressions like “inexplicable and frenzied hurry” and “unseemly haste” used by High Court judge Justice Anup Bhambhani in his seven-page order on May 27 to describe the manner in which Mr. Navlakha was taken to Mumbai.
Justice Bhambhani had discovered it puzzling how the National Investigation Firm (NIA) took Mr. Navlakha out of the National Capital a day before his bail hearing was arranged prior to the High Court.
The apex court, however, said the High Court had no jurisdiction to hear the bail application. It needs to be appropriately heard by the Bombay High Court as
