Fazluzzaman Mazumder, an attorney who practices at the court, stated the Oaths Act of 1969 that requires swearing in the name of God in a courtroom is a limitation to the workout of liberal and clinical thinking ensured by Article 25 of the Constitution of India. In his petition to the court, he stated Form 1 and Section 6 of the Oaths Act make an individual swear in the name of God while stating anything in court. When Article 25 safeguards the rights of followers and non-believers, he asked why an atheist petitioner ought to be made to take oath in the name of God. Mr Mazumder stated he “is not a follower in supernatural power or entity” as a “nonreligious, liberal and scientific-minded resident” and thinks there is “no religious beliefs higher than brotherhood and humankind”. He does not observe any spiritual routines in his individual life and as a result does not think in the presence of God, he stated. He included that his right to not think in any religious beliefs or supernatural entity is identified and ensured under Article 25 and 26 of the Constitution.
