The union that represents security guards at the Bank of Canada has filed a fourth complaint against the Crown corporation, claiming it continued to pay replacement workers during a months-long strike after it was ordered not to.

The Public Service Alliance of Canada (PSAC) filed the complaint at the Canada Industrial Relations Board (CIRB) as security guards at the federal institution entered their third month on the picket line.

On July 7, the CIRB found that the Bank of Canada had violated the Canadian Labour Code by paying workers from private security firms, as well as security guards who had crossed the picket line.

The board ordered the bank to stop using those replacement workers.

And then on July 22 the board found that the Crown corporation was still using replacement workers, this time from a different private security firm.

PSAC claimed that the unionized workers who crossed the picket line continued to get paid up until at least July 24 despite the second labour board decision.

“We don’t have a total dollar value for those payments … but the bigger issue for us is the preferential treatment: employees who crossed the picket line continued receiving compensation while members exercising their legal right to strike went without their regular pay and benefits,” Ruth Lau MacDonald, PSAC regional executive vice-president for the National Capital Region, said in an emailed statement.

Almost 50 security guards in Ottawa and Montreal have gone on strike, leading to Bank of Canada employees having to work from home since the strike began on June 23.

In response to PSAC’s latest complaint, the Bank of Canada said it would “respond to this complaint through the CIRB, which is the appropriate channel.”
