The US Department of Homeland Security

(DHS) proposes to issue regulations determining unlawful presence by non-immigrants, which can lead to a bar on re-entry for three or ten years. The proposed rules will be issued by March next year and typically would be subject to the public comment process.

An action point in the spring 2020 agenda of the Trump administration states that the proposed regulations may include or expand upon the current agency policies. Further, DHS also intends to address how non-immigrants may be admitted back to the US after completion of the time-bar period.
